Terms of Service

1. Agreement to Terms

By accessing and using Perfecta ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. Perfecta is operated by Real Estate Photo AI ("we," "us," or "our").

2. Description of Service

Perfecta is an AI-powered real estate photo editing platform that provides:

• AI-powered photo decluttering and enhancement
• Object removal (cars, power lines, clutter, etc.)
• Lighting and color correction
• 4K upscaling and resolution enhancement
• White-glove "Perfecta" full-service editing

The Service uses artificial intelligence and may not produce perfect results in all cases. Results may vary based on image quality and content.

3. Account Registration

• You must be at least 18 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access
• One person or entity may not maintain multiple free accounts

4. Credit System and Pricing

4.1 Free Credits

• New users receive 5 free credits upon signup
• Free credits are for trial purposes only
• One free trial per person/entity

4.2 Credit Purchases

• Credits can be purchased in packs (50, 100, 250, 500, 1000 credits)
• Pricing is displayed at checkout and subject to change
• Credits never expire
• Credits are non-transferable between accounts
• Bulk enterprise pricing available upon request

4.3 Credit Usage

• Standard edits: 1-3 credits per photo (depending on complexity)
• Perfecta white-glove service: 3 credits per photo
• Credits are deducted when processing begins
• Failed processing may result in credit refund at our discretion

5. Payment Terms

• All payments are processed securely through Stripe via Polar.sh
• Prices are in USD unless otherwise stated
• You agree to pay all charges at the prices in effect when incurred
• We reserve the right to change prices with notice
• All sales are final - no refunds on purchased credits
• Credits already used cannot be refunded
• Chargebacks may result in account suspension

6. User Responsibilities and Prohibited Conduct

6.1 Content Ownership

You represent and warrant that:

• You own or have the right to upload all photos you submit
• Your content does not violate any third-party rights
• You have necessary permissions for property photos

6.2 Prohibited Uses

You agree NOT to:

• Upload illegal, offensive, or inappropriate content
• Use the Service for any unlawful purpose
• Attempt to reverse engineer or copy our AI technology
• Scrape, crawl, or automated access without permission
• Resell or redistribute processed photos as a service
• Share account credentials with others
• Circumvent credit usage or payment systems
• Overwhelm or damage our infrastructure

7. Intellectual Property Rights

7.1 Your Content

• You retain all ownership rights to photos you upload
• You retain all ownership rights to processed photos
• You grant us a limited license to process and store your photos
• We may use before/after examples for marketing with your consent

7.2 Our Content

• Perfecta platform, software, and AI models are our property
• Our trademarks, logos, and branding are protected
• You may not copy, modify, or reverse engineer our technology

8. Service Availability and Limitations

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• We may perform maintenance that temporarily affects availability
• Processing times may vary based on server load
• We reserve the right to impose usage limits
• Beta features may be unstable or discontinued

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

• We do not guarantee specific results or perfect edits
• AI processing may have errors or unexpected results
• We are not responsible for MLS rejections or listing issues
• Processed photos should be reviewed before use
• We do not warrant that the Service will be error-free or secure

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERFECTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Perfecta, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your uploaded content
• Your violation of these Terms
• Your violation of any third-party rights

12. Account Termination

12.1 By You

• You may delete your account at any time from settings
• Unused credits are forfeited upon account deletion
• Your photos will be deleted within 30 days

12.2 By Us

• We may suspend or terminate accounts for Terms violations
• We may terminate accounts for fraudulent activity
• We may discontinue the Service with 30 days notice
• Terminated accounts forfeit remaining credits

13. Data Retention and Deletion

• Original photos: Retained for 90 days unless deleted earlier
• Processed photos: Retained for 90 days unless deleted earlier
• Account data: Retained until account deletion
• Transaction records: Retained for legal/tax requirements (7 years)
• You may request data deletion at any time

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on the Service. Your continued use after changes constitutes acceptance. If you do not agree to modified Terms, you must stop using the Service.

15. Governing Law and Disputes

• These Terms are governed by the laws of the State of Arizona, USA
• Disputes shall be resolved in the courts of Arizona
• You agree to attempt good-faith resolution before litigation
• Class action lawsuits are waived

16. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and Perfecta
• Severability: If any provision is unenforceable, the rest remains in effect
• No Waiver: Our failure to enforce any right does not waive that right
• Assignment: You may not transfer your account; we may transfer our rights
• Force Majeure: We are not liable for delays due to circumstances beyond our control
